1. Agreement to Terms

Welcome to PeopleFinder. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PeopleFinder ("Company," "we," "us," or "our") governing your access to and use of the PeopleFinder mobile application and related services (collectively, the "Service").

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

2. Eligibility and User Affirmations

By using PeopleFinder, you affirm and represent that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• You are NOT a citizen or resident of a European Union member country.
• You will use the Service only in jurisdictions where facial recognition and people search services are legally permitted.
• You will comply with all applicable local, state, national, and international laws and regulations.

3. Description of Service

PeopleFinder provides reverse image search and people finder services that allow users to:

• Upload photos to search for matching images across the internet
• Search for individuals using names and other identifying information
• Access publicly available information about individuals
• Verify online identities and detect potential fraudulent profiles

Our Service utilizes third-party APIs and data sources to provide search results. We do not guarantee the accuracy, completeness, or availability of any information provided through the Service.

4. Prohibited Uses

You agree NOT to use the Service for any of the following purposes:

4.1 Illegal Activities

• Any activity that violates applicable laws or regulations
• Stalking, harassment, or threatening any individual
• Identity theft or fraud
• Any activity that could result in criminal liability

4.2 Discriminatory Decisions

You shall NOT use the Service to make decisions about any person regarding:

• Employment or hiring
• Housing or rental applications
• Credit or lending
• Insurance coverage or rates
• Educational opportunities
• Any other purpose covered by the Fair Credit Reporting Act (FCRA) or similar laws

4.3 Searches Involving Minors

• Uploading photos of individuals under 18 years of age
• Searching for or attempting to locate minors
• Any use that could potentially harm or exploit children

4.4 Jurisdictional Restrictions

• Using the Service in jurisdictions where facial recognition or people search services are prohibited
• Providing the Service or results to users in restricted jurisdictions
• Circumventing geographic restrictions

4.5 Technical Violations

• Attempting to reverse engineer, decompile, or disassemble the Service
• Using automated tools, bots, or scrapers to access the Service
• Interfering with or disrupting the Service or its infrastructure
• Attempting to gain unauthorized access to any systems or data

5. User Content and Uploaded Photos

5.1 Your Responsibilities

You are solely responsible for all content you upload or submit to the Service, including photos. You represent and warrant that:

• You have the right to upload and use any photos you submit
• The photos do not infringe on any third party's intellectual property or privacy rights
• The photos do not contain illegal content
• The photos are not of individuals under 18 years of age

5.2 License Grant

By uploading photos to the Service, you grant us a limited, non-exclusive, worldwide license to process, transmit, and analyze the photos solely for the purpose of providing the Service. This license terminates upon deletion of the photos from our systems.

5.3 Photo Retention

Photos uploaded to the Service are processed and automatically deleted within 24 hours of search completion. We do not retain copies of your uploaded photos beyond this period.

6. Subscriptions and Payments

6.1 Subscription Plans

PeopleFinder offers both free and premium subscription plans. Premium features may include:

• Unlimited searches
• Full access to search results
• Advanced search features
• Priority processing

6.2 Billing

Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually) depending on the plan selected. Payment will be charged to your chosen payment method at confirmation of purchase.

6.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your app store account settings.

6.4 Refunds

All purchases are final. Refund requests are handled according to the policies of Apple App Store or Google Play Store, as applicable. We do not provide direct refunds.

6.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated in advance and will apply to subsequent billing periods.

7. Disclaimer of Warranties

7.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Warranty of Accuracy

WE MAKE NO WARRANTY, AND EXPRESSLY DISCLAIM ALL WARRANTIES, AS TO THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY INFORMATION PROVIDED BY THE SERVICE. Search results may contain errors, inaccuracies, or outdated information.

7.3 Third-Party Services

We utilize third-party APIs and data sources. We do not control and are not responsible for the accuracy or availability of third-party services.

7.4 No Professional Advice

Information provided through the Service is for informational purposes only and does not constitute legal, professional, or investigative advice.

8. Limitation of Liability

8.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEOPLEFINDER, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

8.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless PeopleFinder, its parent company, subsidiaries, affiliates, owners, stakeholders, officers, directors, employees, agents, and representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy or intellectual property rights
• Any content you submit to the Service
• Your violation of any applicable laws or regulations

10. Release and Waiver

You hereby irrevocably and unconditionally waive, release, and forever discharge PeopleFinder, its parent company, subsidiaries, affiliates, owners, stakeholders, officers, directors, employees, agents, and representatives, from any and all claims, actions, demands, liabilities, damages, losses, costs, expenses, lawsuits, judgments, and legal proceedings of any kind, whether known or unknown, that arise from, relate to, or are connected with:

• The content, search results, data, or services provided by or associated with PeopleFinder
• Any third-party services or APIs used in connection with the Service
• Any actions taken based on information obtained through the Service

You expressly waive any rights or benefits under any legal principle, law, or regulation of any jurisdiction that might limit or restrict the extent or application of this release.

11. Compliance and Legal Responsibility

You unequivocally affirm and acknowledge that:

• Your use of the Service complies with all applicable laws, regulations, and policies of your jurisdiction
• You accept and assume full legal responsibility and liability for any consequences arising from your use of the Service
• Any legal consequences resulting from unlawful use or non-compliance shall be borne exclusively by you, without recourse to PeopleFinder
• You will not use the Service in any manner that would require PeopleFinder to be registered, licensed, or report to any government authority

12. Intellectual Property

12.1 Our Rights

The Service, including its original content, features, and functionality, is owned by PeopleFinder and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

12.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

12.3 Restrictions

You may not:

• Copy, modify, or distribute the Service or its content
• Use the Service for commercial purposes without our written consent
• Remove any copyright or proprietary notices
• Create derivative works based on the Service

13. Account Termination

13.1 Termination by You

You may terminate your account at any time by deleting your account through the app settings or by contacting us.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Engaging in prohibited activities
• Upon request by law enforcement or government agencies
• Discontinuation or modification of the Service

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

14.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the decision of the arbitrator shall be final and binding.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending notification through the app (for material changes)

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PeopleFinder regarding the Service and supersede all prior agreements and understandings.
